Terms and Conditions

By submitting an application to the Creators' Fund+ programme, you agree to the following terms and conditions. Please read them carefully before applying. Please note the below is assessed on a case by case basis.

1. Eligibility

By applying, you confirm that you:

a)    Are aged 18 or over at the time of application

b)    Identify as Black, a Person of Colour, or racially minoritised

c)     Are currently resident in Scotland

d)    Work in a creative field (at any stage of your career)

e)    Have provided accurate and truthful information in your application

2. Residency Requirements

You must be resident in Scotland for the duration of the programme. If your circumstances change and you plan to move outside Scotland:

f)      You must notify We Are Here Scotland within 14 days

g)    We Are Here Scotland will decide whether you can complete the programme remotely or whether you will be required to repay any unspent funding

Failure to notify us of a change in residency may result in a requirement to repay all funding received.

3. Funding and Payment

The total funding package is worth up to £2,980, comprising:

h)    £1,514 direct funding for your creative development (paid in advance)

i)      £586 for mentoring attendance (8 hours at £55 per hour, plus travel/access costs)

j)      £880 mentor fees (paid directly to your mentor by We Are Here Scotland)

Payment schedule:

k)     The £1,514 direct funding will be paid in advance upon confirmation of your place on the programme

l)      The £586 mentoring attendance payment will be paid after each mentoring session or upon completion of all mentoring hours. You may choose to pay yourself for your time or put this towards your project costs.

Payments will be made via bank transfer. You must provide accurate bank details when requested.

4. Programme Expectations

As a funded creative, you agree to:

m)   Participate actively in the 12-month programme

n)    Attend and engage with your mentoring sessions

o)    Participate in two check-ins with the We Are Here Scotland team (at month 6 and month 12)

p)    Provide receipts and evidence of how you have spent your funding

q)    Respond to communications from We Are Here Scotland in a timely manner

r)      Participate in a showcase or sharing of your work at the end of the programme (format to be agreed)

5. Withdrawal and Non-Completion

If you need to withdraw from the programme:

s)     Please contact us as soon as possible to discuss your situation

t)      You will be required to repay any unspent funding

If you become uncontactable:

u)    If we are unable to reach you after three contact attempts over a 28-day period, you will be considered to have withdrawn from the programme

v)     In this case, you will be required to repay all funding received

We Are Here Scotland reserves the right to exclude individuals who do not complete the programme from future funding opportunities.

6. Behaviour and Conduct

All participants are expected to behave respectfully towards We Are Here Scotland staff, mentors, and other programme participants. The following behaviours are not acceptable:

w)   Harassment or abusive behaviour towards staff, mentors, or other participants

x)     Discrimination based on race, gender, sexual orientation, disability, religion, or any other protected characteristic

y)     Actions that bring We Are Here Scotland or the programme into disrepute

z)     Fraud or misuse of funding

aa) Being charged or convicted of a serious criminal offence during the programme

bb) Breaching the confidentiality of other participants

Consequences will be proportionate to the seriousness of the issue and may include:

cc)  A warning and opportunity to address the behaviour

dd) Suspension from programme activities

ee) Termination from the programme and requirement to repay funding

ff)    Exclusion from future We Are Here Scotland opportunities

Decisions about conduct issues will be made by We Are Here Scotland directors and management.

7. Safeguarding

All participants and mentors agree to abide by We Are Here Scotland's Safeguarding Policy. A copy of this policy is available on request. If you have any safeguarding concerns during the programme, please contact our Designated Safeguarding Lead, Ica Headlam (ica@weareherescotland.com) or Deputy Safeguarding Contact, Halina Rifai (halina@weareherescotland.com).

8. Publicity and Marketing

By accepting a place on the programme, you agree that We Are Here Scotland may:

gg) Use your name to announce you as a funded creative

hh) Use photographs or video of you taken during programme activities

ii)     Share quotes or testimonials from you about the programme

jj)     Feature examples of your work in promotional materials

If you have personal safeguarding concerns that mean you cannot be publicly identified, please let us know and we will work with you to find alternative arrangements.

9. Intellectual Property

You retain full ownership of all work you create during the programme. We Are Here Scotland does not claim any rights over your intellectual property.

10. Data Protection

We Are Here Scotland is committed to protecting your personal information in accordance with UK GDPR. We will:

kk)  Only collect information necessary to administer the programme

ll)     Store your information securely

mm)       Not share your personal information with third parties without your consent, except where required by law or for safeguarding purposes

nn) Delete your information in accordance with our data retention policy

Anonymised data from your application may be used to report to funders and to improve our programmes. Equality monitoring data is collected anonymously and is not linked to your application.

11. Programme Changes

We Are Here Scotland reserves the right to make reasonable changes to the programme if necessary. This may include:

oo) Changes to the showcase format or date

pp) Changes to mentor availability (we will offer an alternative mentor)

qq) Changes to session delivery (for example, moving from in-person to online if needed)

rr)    Adjustments to the programme timeline in exceptional circumstances

We will always communicate any changes to you as soon as possible and work with you to minimise any disruption.

12. Appeals and Complaints

Appeals:

Due to the volume of applications, we are unable to provide individual feedback to unsuccessful applicants. If you believe there has been an error in the assessment of your application, you may submit an appeal in writing to hello@weareherescotland.com within 14 days of receiving your outcome.

Complaints:

If you have a complaint about any aspect of the programme, please contact us at hello@weareherescotland.com. We will acknowledge your complaint within 5 working days and aim to provide a full response within 20 working days.

If you are not satisfied with our response, you may request that your complaint is reviewed by an independent mediator agreed by both parties.

13. Agreement

By submitting your application to the Creators' Fund+ programme, you confirm that you have read, understood, and agree to these Terms and Conditions.
